These terms set out the agreement between you and The Scalable Creative (referred to as TSC, we, or us) when you apply to, purchase, or access the SCALE Framework mentorship programme and the related tools and community (the Programme).

By submitting an application or completing payment, you confirm that you have read these terms and accept them.

Who we are

The Programme is operated by Thomas Gamblin, trading as The Scalable Creative, based in the United Kingdom. For all enquiries relating to these terms, contact hello@thescalablecreative.com.

Definitions

  • Programme means the SCALE Framework mentorship, including the software tools, the build courses, the community space, and the contact moments described on our website at the time of purchase.
  • Tools means Helix, FLOMAP, the Snapshot diagnostic, and any other software made available as part of the Programme.
  • Member means an individual who has been accepted into the Programme and whose access is current.
  • Content means all video lessons, written materials, frameworks, prompts, and other resources made available inside the Programme.

Application and acceptance

Access to the Programme is by application. We review each application and may accept or decline at our discretion. We are not obliged to give reasons for a decision.

Where an application is accepted, access begins when payment is received and your account has been provisioned.

Payment and pricing

The Programme fee is shown in GBP on our website at the time of purchase. Equivalent values in EUR and USD are shown for reference and may move with currency markets.

Payment may be made in full or, where offered, in two scheduled instalments. Where instalments are used, the second instalment is taken on the date set out at checkout and is treated as already due. Failure to complete the second instalment may result in suspension of access until payment is received.

All payments are processed by our payment provider, Stripe. We do not store full card details.

Satisfaction window and refunds

We offer a fourteen day satisfaction window from the date your access is provisioned. If you decide within those fourteen days that the Programme is not for you, contact us and we will issue a full refund of fees paid.

After the fourteen day window has closed, the fee is non-refundable. Access is the product. The Programme is delivered immediately and in full from day one, and the fee reflects that.

A separate, work-conditional guarantee may apply to specific cohorts or campaigns. Where one applies, the conditions will be made clear at the point of purchase and will form part of the agreement for that purchase.

Programme access and duration

Members receive twelve months of access from the date access is provisioned. This includes the Content available at the start of the membership, any updates to existing Content during the twelve months, and any new Content released within the same twelve-month window.

Continuing access after twelve months, if offered, is at our discretion and may be subject to a separate fee.

Acceptable use

Your access is personal to you. You agree not to:

  • Share your login credentials with any other person.
  • Resell, sublicense, or otherwise commercially redistribute any part of the Content or Tools.
  • Reproduce the Content in whole or in substantial part outside the Programme without our written permission.
  • Use the Tools to train any third-party model, build a competing product, or extract our proprietary methodology.
  • Engage in any conduct in the community that we reasonably consider abusive, discriminatory, or unlawful.

Breach of this section may result in suspension or termination of access without refund.

Intellectual property

The SCALE Framework, the Content, the Tools, and all related materials are owned by us or our licensors and are protected by copyright and other intellectual property laws.

You retain ownership of the inputs you provide and of the outputs produced for your own business through your work inside the Programme, including your AI-IP Blueprint. We are granted a non-exclusive, limited licence to process those inputs only to operate the Programme and the Tools for you.

Nothing in these terms transfers ownership of the SCALE Framework or any of the Tools to you.

Community and confidentiality

The community space is provided to support members in working through the Programme. Information shared by another member inside the community is to be treated as confidential to that member and is not for repetition, screenshotting, or onward sharing outside the community.

No guarantee of results

The Programme provides a methodology, tools, and support. It does not guarantee any specific business, revenue, or commercial outcome. Outcomes depend on the work done by the member and on circumstances we do not control.

Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising from your use of the Programme is limited to the total fees you have paid to us under these terms in the twelve months preceding the claim.

We do not exclude or limit liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited by law.

Suspension and termination

We may suspend or terminate your access if you breach these terms, or if continued access would expose us or other members to risk. Where access is terminated for breach, no refund is due.

You may cancel auto-renewing components, where they apply, at any time from your account.

Changes to the Programme

We continuously develop the Programme. We may update Content, refine the Tools, and adjust the way contact moments are delivered. Where a change materially reduces what is provided, we will give reasonable notice and, where appropriate, an option to opt out.

Changes to these terms

We may update these terms from time to time. The version that applies to your purchase is the one in force at the time you paid, unless a later change has been notified to you and you have continued to use the Programme after that notice.

Governing law and jurisdiction

These terms and any dispute arising out of them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, save that we may bring proceedings in any jurisdiction where you reside or do business.
